10FRAMEWORK AGREEMENT FOR THE PROCUREMENT OF SNOW CLEARING SERVICES

Aug.Grimstad municipality shall enter into a framework agreement with several tenderers for winter maintenance; snow ploughing, gritting and clearing snow and ice on municipal roads and open spaces, as well as setting out snow stakes. The framework agreement is divided into three parallel sub-contracts divided in accordance with machine types: tractors, small wheel loaders (4-8 tons) and large wheel loaders (8-16 tons). This notice concerns snow clearing areas of roads, as well as clearing areas for municipal purpose-built buildings. Tenderers shall not submit tender offers on specific routes, it is the contracting authority who will award the routes after the tender deadline has expired. The expected tenderers will have route maps distributed in a reasonable time before the snow clearing season. As the areas are dynamic and changes can occur, the routes will be divided according to a total assessment of the following criteria: the machine ́s suitability, efficient operations planning and cost-benefit connected to geographical location and costs of moving around. The contracting authority always aims to divide the sections so that they generate approx. as many hours. Changes must be expected in the routes, but will be agreed further per season. Tenderers must reckon on clearing areas within the entire municipality. During the agreement period there will be a need for occasional snow clearing in accordance with the contracting authority ́s needs. Tenderers must therefore reckon on extra assignments beyond the routes. A previous route overview and a map of roads and institutions are attached together with the tender documentation (Annexes 1, 2 and 3). These are outdated and new areas are under revision. Tenderers must expect changes to the extent of individual routes. Attvin ASÅlesundThe contracting authority would like to use this procurement to enter into a framework agreement with one tenderer. The aim of the contract is to cover the contracting authority ́s need for transport and treatment of hazardous building waste, from Attvin to final treatment at a certified treatment facility, in accordance with the requirement specifications. The aim is also to ensure that hazardous waste is taken care of in such a way that it does not create pollution or damage to humans or animals, or danger to it, and to contribute to an appropriate and reliable system for handling hazardous waste, cf. The Waste Regulations chapter 11. The contract is for: Waste with phthalates (e.g. floor coverings), waste that contains bronched flame retardants, waste containing chlorinated paraffins and for the options waste that includes PUR foam insulation and pressure impregnated and creosoted wood. Comments on the contract: Responsibility for the waste is to be taken over by a tenderer when the waste is charged in the tenderer ́s vehicles. The procurement is for the treatment of various types of hazardous building waste and building waste that cannot be handled together with normal household and commercial waste due to chemical, physical and/or biological qualities. Waste types included in this agreement are in accordance with the price form. Everything that is collected as hazardous waste shall be treated at a certified treatment facility. Emphasis is put on the fact that the hazardous waste in accordance with this agreement shall be directly to the final treatment facility and not the reception facility. Tenderers shall, thus, offer final treatment of the hazardous waste at one/several treatment facilities in accordance with requirements. Fractions other than what is stated may be included in this agreement. The volume of NOK shall not, nevertheless, exceed the maximum amount set for the contract. New waste types in the contract period: If new waste types are added in the contract period, it shall be possible for the customer to enter into this agreement if they do not make up a significant part of the contract. In such cases the same price calculations shall be used for new waste types as for other waste types in this contract. The contracting authority reserves the right, however, to hold a new competition for new waste types during the contract period. The objective of the agreement is to cover the customers ́needs for collection, transportation and treatment of milled wood from Attvin Produksjon AS. The contracting authority would like as much wood as possible to be used for a certified treatment facility, for recycling. The remaining amounts shall be for energy recovery at certified incineration plants. The municipality intends to sign a contract with Framsikt AS (organisation number 913187512) after 10 working days. Evenes municipality needs a system that shall be integrated with the ERP system Visma Enterprise. The system shall be used within the following main areas: analysis, preparation of the financial plan, budgeting, reporting and political interaction. The system shall facilitate simple production of an easy-to-use and informative action programme, budget and financial plan, as well as other ongoing reports. The most relevant modules are for analysis, economy plan, annual budget, reporting and politician module. Evenes municipality has examined the extent of any alternative software available on the market. This has happened through searches on the internet and collecting information about procurements of an equivalent system in other municipalities. Evenes municipality cannot see that there are any alternative applications in the market than Framsikt AS ́s system, which covers the total need for comprehensive management governance application system at the municipality, in Norwegian, in one combined standard ERP system. The procurement is outside the scope of the procurement regulations, as Framsikt AS is the only tenderer in the market for such a system as far as we have been able to uncover. Tenderers can deliver a comprehensive system for economy planning including reporting and publication of the work. The system includes modules for analysis, assessment, plans, investment, financial plan, annual budget, comprehensive management governance and reporting, personnel reporting, corporate governance and politician module. Evenes municipality has not seen other systems that can cover the need for general governance management in the same way as the system from Framsikt AS. The procurement will be seen as fulfilment of the Public Procurement Regulations (FOA) § 13-4 letter b no. 2 and no. 3: A contracting authority can hold a procurement without a competition if the procurement concerns "services that only a specific supplier can deliver" because "competition is impossible for technical reasons", cf. point 2, or "the tenderer has the sole right, including immaterial rights", cf. point 3.
