SYKEHUSINNKJØP HFVADSØThe justification for awarding to the Contracting Authority assesses that there is a basis for entering into a temporary contract directly with Vivicta AS. The contracting authority will not use this notice as a final choice for future administrative digital target architecture, system model or contract structure. Future strategic direction shall be assessed through a separate management process, market dialogue and any procurements. The justification for the temporary contract is that the contracting authority is in a forced continuity situation connected to the existing production system. The situation is triggered by the manufacturer/supplier ́s technological direction and information that the current delivery platform cannot be continued unlimited. At the same time, future strategic direction for the administrative system landscape is not finally defined. Within the available timeframe, the contracting authority ́s assessment is not a real and reliable alternative that can ensure a continuation of the existing production system and the accompanying performance critical administrative core functions without unacceptable operational risk. The existing system has been established, configured and integrated over a long period of time. It is included in ongoing finance, invoice, reporting, integration and data basis processes. The system has integrations, data, roles, access structures, reporting set-up and management routines that are connected to the existing delivery model and the tenderer's operational and management responsibilities. The contracting authority will assess that clarification of future target architecture, market dialogue and any procurements for this system area will require considerable time. A procurement process is expected to take at least 12 months, and subsequent implementation, migration, testing, training, integration work and production will normally require a further 12-24 months. An immediate competition for full compensation or future target architecture will therefore not be able to help the acute continuity need. Alternative suppliers will also not be able to take over responsibility for the existing production system in a proper manner within the available deadline, without access to the necessary rights, system competence, operational environment, history, configuration, integration knowledge and supplier specific management competence. The agreement is, therefore, time-limited to what is deemed necessary to ensure reliable operation and continuity of the existing production system and the accompanying business critical administrative functions until the contracting authority has completed strategic clarification, market dialogue and any procurements. The agreement period is 3 years, which is the minimum time for binding. Legal basis The contracting authority assesses that the terms for direct contract award are fulfilled for the temporary contract. The legal basis will particularly be assessed against the procurement regulations § 13-4 letter b no. 2 and/or no. 3, where the procurement without a competition can be used when the service can only be delivered by a specific supplier for technical reasons or due to sole rights, provided that there are no reasonable alternatives and that the missing competition is not due to the contracting authority having adapted the procurement to a specific tenderer. The contracting authority emphasises that the assessment concerns a narrow and temporary continuation of the existing production system and associated activity critical administrative functions in a limited transition period. This does not apply to a general assessment of the market for future administrative digital systems and it does not involve a permanent choice of future platform, system architecture or supplier. The contracting authority estimates that at the time of the temporary contract there is not a reasonable and reliable alternative to Vivicta AS in order to ensure continuity of the existing ERP system in the period. The lack of competition is related to time critical and technical/operational continuation of an established production system, not to the contracting authority ́s future strategic needs. Subsidially, the need will also be assessed in light of the narrow exception rules on time-critical conditions and the necessary measures to safeguard continuity, but the contracting authority places decisive emphasis on the contract being for the technical and operational continuation of the existing system, not permanent choice of future ERP system.463 Framework agreement for the procurement of administrative services
Norsk nukleær dekommisjonering (NND)HALDENDeadline: Aug 25The procurement of administrative services within HR, finance and accounting, project and case processing, as well as analyses for NND and IFE NUK, located in Halden and Kjeller. IFE NUK Kjeller has an option to use the contract before the planned transfer of business, which has the provisional date 1 January 2027. The framework agreement shall contribute to respite the organisation in periods with high workloads and for vulnerability related to manpower. NND shall carry out a transfer of business and take over IFE NUK Kjeller with approx. 200 employees, so that the supplier market must be able to support a business with two locations. The framework agreement shall further ensure NND ́s access to services where there is a need to obtain expertise outside the company's own core competence. The services will apply to both assignment based deliveries and the hire of labour, depending on the need and the at any given time applicable agreements with elected representatives. NND currently has a framework agreement with one tenderer in several of the disciplines. This contract is about to expire. The municipalities have several locations with different types of activity and waste flow. This sets requirements for a system that provides better control, more enjoyable practice and simple operation across addresses and devices. There is also a need for safe systematic handling of hazardous waste and other waste fractions that require special follow-up. The aim of the procurement is to establish a uniform and operational friendly system for the collection, transport and treatment of business waste. The system shall contribute to better compliance with regulations, a higher degree of sorting, more predictable logistics and better documentation of waste management in the municipality. Description of the assignment The assignment includes collection, transportation and treatment of business waste from several locations and different addresses in the municipalities. The procurement shall cover the municipalities ́ continuous need for waste management through a combined and uniform service. The delivery shall include handling mixed commercial waste and relevant waste fractions, including food waste, glass and metal, cardboard, plastic, residue waste, hazardous waste, EE-waste, confidential waste and infected waste. The assignment also includes the necessary handling and follow-up of fractions that require special documentation and traceability. A flexible collection scheme is requested that safeguards both planned emptying and the need for extra emptying and urgent orders. The system shall support predictable logistics and equal practice across the municipality ́s locations. Furthermore, tenderers shall offer relevant follow-up and general documentation connected to the execution of the assignment. The multidisciplinary services shall include but not be limited to Architecture, Structural & Civil Engineering, Mechanical Engineering, Electrical Engineering (including expertise in Photovoltaic Systems), ICT Engineering, Fire Safety Engineering, Cost planning and Estimating services and Landscaping. Due to the multidisciplinary nature of the requirement, it is anticipated that the services will be provided based on: - A single consultancy which can offer all the disciplines from its in-house capabilities. - A single consultancy which is acting lead as consultant and is offering some of the disciplines on a sub-consultancy basis: in this instance, the lead consultant shall be providing the architectural discipline. - A consortium or joint venture arrangement: again, one company from the consortium or joint venture will be required to act as lead consultant, providing the architectural discipline. Project Scope The final project solution remains to be confirmed and shall be developed through the feasibility and design stages. The preferred solution may include one or more design solutions, but range from the provision of the following options: an open surface car park or carparks; an open two-storey car park structure; or a combined solution incorporating both open car parking and a two-storey car park structure. Commission for Regulation of UtilitiesDublinSection 47 of the 1999 Act, which refers to section 45 of the Electricity Supply Act 1927, gives the Contracting Authority legal powers to decide to grant or refuse to grant a special order on the application of ESB, or of a holder of an authorisation to construct or reconstruct a generating station for the purpose of supply to final customers, or to construct an interconnector, or of a person who has applied for such an authorisation, in certain circumstances. Section 45 of the Electricity Supply Act sets out the legal basis for the compulsory acquisition of any land, easement, or other right over land, or to acquire or use compulsorily any right over land by special order. Section 45 also establishes a procedure for exercising that compulsory acquisition power. In considering whether or not to grant a special order the Contracting Authority may hold a public inquiry. The Contracting Authority expects that one or more applications for a special order may be received and is seeking (by this Competition) to appoint a framework of Inspectors.
