The contracting authority considers that the procurement can be covered by the exception in the public procurement regulations § 5-2 first section letter a, because the contract, after a concrete assessment, can only be entered into with one specific tenderer in the market. The assessment is based on the fact that the need does not apply to general administrative or event technical services, but ongoing assistance at the intersection of schools, research, business and the public sector, where the delivery requires both in-depth system understanding, established relationships and operative implementation ability in the existing cooperation structures. The contracting authority has not identified other actors who, in total, can fill this function. It is crucial, after the contracting authority ́s assessment, not that Blå Kompetansesenter AS has provided equivalent services in the past, but that the company has an established and special role in the relevant eco-system and thus has a combination of competence, network, anchoring and availability that is not replaceable through ordinary competition at the current time.
