Kliniken der Stadt Köln gGmbHKölnDie Kliniken der Stadt Köln gGmbH (nachfolgend AG genannt) beabsichtigt im Rahmen des vorliegenden Vergabeverfahrens den Abschluss einer Rahmenvereinbarung zur Beschaffung der in der Leistungsbeschreibung und den weiteren Vergabeunterlagen beschriebenen Software-Lizenzen des Herstellers Microsoft mit und ohne Software Assurance (SA) sowie im Bedarfsfall Dienstleistungen, die im Zusammenhang mit dem Erwerb und der Verwaltung dieser Lizenzen stehen auf Grundlage des zwischen der Bundesrepublik Deutschland, vertreten durch das Bundesministerium des Innern (BMI), und der Microsoft Ireland Operations Limited abgeschlossenen aktuell gültigen „Microsoft Business and Service Agreement“ Nr. U5223585, (sog. „MBSA“) sowie des „Konzernvertrag“ (sog. „Enterprise Agreement“, mit den Vertragsnummern Nr. 4785551 für Plattform und Nr. 5249528 für Komponenten – Enterprise Agreement und MBSA zusammen „Konditionenverträge“). Dem Auftraggeber liegt eine Beitrittsberechtigung zu den Konditionenverträgen des BMI vor. Der geschätzte Wert der Leistungen, der während der Laufzeit dieser Rahmenvereinbarung pro Jahr abgerufen werden kann beträgt 1,6 Mill. € netto p.a. Der Höchstwert der Leistungen, der während der Vertragslaufzeit von vier Jahren (drei Jahre Anfangslaufzeit zuzüglich der Einbeziehung der Ausübung des Verlängerungsrechts um ein Jahr mit Zuschlagserteilung) unter dieser Rahmenvereinbarung abgerufen werden kann, beträgt 7,4 Mill. € netto. Es handelt sich bei den vorstehenden Werten nicht um Mindestabnahmemengen oder -werte. Die sich aus den Konditionenverträgen ergebenden Mindestbestellmengen ausgenommen, wird eine bestimmte Leistungsmenge von der AG nicht garantiert. Die Vorgabe von Produkten der Microsoft Corporation hinsichtlich der benötigten Lizenzen ist in Einklang mit § 31 Abs. 6 VgV sachlich gerechtfertigt. Insoweit ist es zulässig, im Interesse der Systemsicherheit und Funktion jedwedes Risikopotenzial, das die Verbindung verschiedener und komplexer IT-Systemkomponenten mit sich bringen, auszuschließen und den zuverlässigsten Weg der „Ein-Hersteller-Strategie“ zu wählen. Die Software-Landschaft der AG basiert auf Softwareprodukten der Microsoft Corporation.
