Die Stadt Duisburg plant die Erteilung einer BMA-Konzession an einen Konzessionsnehmer für die Dauer der Vertragslaufzeit. Der Zeitraum der Leistungserbringung beginnt mit Auftragserteilung frühestens jedoch am 01.01.2027 und endet nach 120 Monaten. Es handelt sich um eine Konzessionsvergabe nach §§ 105 und 148 ff. GWB i.V.m. der Konzessionsvergabeverordnung (KonzVgV). Sollten in der Bekanntmachung andere Verweise aufgeführt sein, erfolgen diese systemseitig durch das Vergabe-Management-System. Dieses Vergabeverfahren wird somit nach den Bedingungen der Konzessionsvergabeverordnung (KonzVgV) durchgeführt. Soweit in der Bekanntmachung auf die Vergaberichtlinie 2014/24/EU Bezug genommen wird, erfolgt auch dieser fehlerhafte Verweis systembedingt durch das Vergabe-Management-System. Maßgeblich für dieses Vergabeverfahren ist die Richtlinie 2014/23/EU.

Die Konzessionsgeber planen die Erteilung einer BMA-Konzession an einen Konzessionsnehmer für die Dauer der Vertragslaufzeit. Der Konzessionsnehmer erhält das ausschließliche Recht, eine öffentliche Alarmübertragungsanlage für Brandmeldungen zu errichten, zu unterhalten und zu betreiben sowie Teilnehmer an diese Alarmübertragungsanlage anzuschließen (Variante 1, gemäß Systemübersicht Anlage 1). Weiter muss der Konzessionsnehmer vom Konzessionsgeber zugelassenen Errichtern die Möglichkeit geben, dessen Technik an seine Alarmübertragungsanlage anzuschließen und zu betreiben.
