Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021_RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass über die gesamte Vertragslaufzeit ein Bedarf von ca. 1.840 Fahrradjacken 2 in 1 besteht. Die Höchstmenge der anliegenden Rahmenvereinbarungen wird auf 2.392 Fahrradjacken 2 in 1 beziffert.
